„The second hearing of the lawsuit by editor Cyntia Harasim against Marta Lempart and Klementyna Suchanow is behind us.

On 26.10.2022, the first court hearing in the case from the lawsuit of editor Cyntia Harasim against Marta Lempart and Klementyna Suchanow took place. At the hearing, a witness – one of the journalists present during the whole incident – gave his testimony. The journalist talked about the scandalous course of the press conference, the selection of journalists, and how Marta Lempart and Klementyna Suchanow behaved.

During the second trial (29.11.2022), a witness who recorded the entire incident and later posted it on the KOD platform gave testimony. The witness confirmed that the defendant M. Lempart addressed journalists who were not allowed into the conference, calling them „propaganda agents.” The witness also pointed out that despite Cyntia Harasim crying and shouting that her leg hurt (which was supposed to be crushed by the door), none of the organizers showed interest in the health condition of the plaintiff.

We will inform you about further developments in this matter. The court has scheduled the next hearing for 15.05.2023 at 12:00. During the trial, which will take place online, the court intends to question the Plaintiff and the Defendants M. Lempart and K. Suchanow.

Reminder:

Editor Cyntia Harasim filed a lawsuit against Marta Lempart and Klementyna Suchanow, which concerned the violation of personal rights and personal integrity of the journalist from Gazeta Polska.

The basis for filing the lawsuit was an incident during which editor Cyntia Harasim, along with other journalists, was not allowed to enter the conference and could not perform her professional duties. During the incident, she suffered a violation of her personal integrity. At the same time, she and other journalists were insulted by Ms. Klementyna Suchanow, among other things, as „dogs,” thus also damaging the journalist’s good name.

Both Ms. Cyntia Harasim and other journalists present at the scene from Telewizja Polska and Telewizja Trwam were prevented from performing journalistic tasks, thereby violating Article 43 and 44 of the Press Law.

On November 30, 2021, the District Court in Warsaw issued an ex parte judgment in this case, ordering activists Marta Lempart and Klementyna Suchanow to apologize to journalist Cyntia Harasim for violating her personal rights. According to the judgment, Marta Lempart and Klementyna Suchanow were obliged to apologize to the journalist – Cyntia Harasim. The court also prohibited the defendants from taking actions that would violate the journalist’s personal rights, such as spreading information that she is a „dog” or a „PIS functionary,” defaming her, violating her physical integrity, and preventing her from performing her professional work.

Furthermore, the court’s judgment obligated Marta Lempart and Klementyna Suchanow to pay compensation to Cyntia Harasim and a deposit of PLN 30,000 to the Social Welfare Home in Broniszewice. The defendants were also burdened with the reimbursement of court costs.

Regarding the court’s judgment, the defendants – Marta Lempart and Klementyna Suchanow filed an objection, thus initiating the full court procedure.”

November 30, 2021. The Warsaw District Court has issued a default judgment ordering activists Marta Lempart and Klementyna Suchanow to apologize to journalist Cynthia Harasim for violating her personal rights. According to the verdict, Marta Lempart and Klementyna Suchanow were ordered to apologize to the journalist – Cynthia Harasim. The court also forbade the defendants to take actions that violate the journalist’s personal rights, i.e. to reproduce information that she is a „dog or a „PIS functionary”, slander, violate bodily integrity and prevent her from performing her professional work.

In addition, the court’s ruling obliged Matra Lempart and Klementyna Suchanow to pay reparations to Cyntia Harasim, and to pay the amount of PLN 30,000 to the Social Welfare Home in Broniszewice. The defendants were also ordered to reimburse the costs of court proceedings.

With regard to the court’s verdict, the defendants Marta Lempart and Klementyna Suchanow filed an objection, hence the initiation of full court proceedings.

Yesterday (26/10/2022) the first court hearing in the case was held. At the hearing, the court heard a witness – one of the journalists present during the entire incident. The journalist talked about the scandalous course of the press conference, the selection of journalists and how Marta Lempart and Klementyna Suchanow behaved.

The next hearing date has been set for November 29, 2022. We will keep you updated on the course of the court proceedings.

Reminder:

Editor Cyntia Harasim, a journalist for Gazeta Polska, was prevented from entering a conference organized by organizers from the so-called Women’s Strike while fulfilling her official duties along with other journalists. During the incident, she suffered a violation of her personal integrity. At the same time, she and other journalists were called „dogs” by Ms. Klementyna Suchanow, among others – which also violated the journalist’s good name.

Both Ms. Cynthia Harasim and other journalists from Telewizja Polska and Telewizja Trwam who were present were prevented from performing their journalistic tasks, in violation of Articles 43 and 44 of the Press Law.
